New York Uniform Code Covers Hot Tubs and Spas

Under the Uniform Code, residential spas and hot tubs over 24 inches deep require permits and either a 48-inch barrier or a listed safety cover meeting ASTM F1346. Electrical bonding and GFCI protection are mandatory. Public spas in hotels, gyms, and HOAs require health department permits, certified operators, and water quality testing under Subpart 6-1 of the State Sanitary Code (10 NYCRR), applied uniformly statewide.

Non-compliant hot tubs face permit denials, removal orders, fines, and operating permit revocation for public spas. Owners may face civil liability for drowning or entrapment incidents.
