Under NYC BC 3109.4, portable spas and hot tubs with a locked, rigid safety cover listed to ASTM F1346 are exempt from the 48-inch barrier requirement. Without such a cover, the hot tub must be enclosed like a swimming pool. Electrical permits are required for 240V hardwired hookups (NEC Article 680). NYC DOHMH regulates communal hot tubs in multi-family buildings under Health Code Article 165.
