Backyard recreational fires are only allowed at 1-2 family homes with private yards, using approved portable fire pits under 3 feet wide. Apartment buildings, brownstones with shared yards, and rooftops are off-limits per FDNY.
NYC Fire Code FC 307.4 permits recreational fires in approved containers at one- and two-family dwellings when set back at least 25 feet from any structure or combustible material (reduced to 15 feet for UL-listed portable pits). Only seasoned wood or charcoal. Fires must be constantly attended with a water source, extinguisher, or hose. Local Bronx brownstone districts with shared rear yards typically cannot meet clearance requirements. Burning leaves, garbage, or construction debris is always prohibited.
