Outdoor burning rules in Bronx County, NY β also called the burn ban, open burning, or fire restriction ordinance β set when you can burn yard waste, debris, or run a recreational fire.
Open burning is prohibited in Bronx County under both NYC Fire Code FC 307 and 6 NYCRR Part 215. Burning leaves, brush, trash, or yard waste is illegal year-round. Only FDNY-permitted ceremonial or cooking fires are allowed.
NY DEC 6 NYCRR Part 215 bans residential open burning in towns with population over 20,000, which includes all of NYC. NYC Fire Code FC 307 further requires a permit for any open flame or bonfire. Cooking fires in approved devices (BBQ grills, fire pits at 1-2 family homes) are the only exception. The statewide March 15-May 15 brush burn ban is moot here because burning is prohibited all year.
FDNY summonses begin at $875. DEC violations can add $500-$2,500. Fires that escape can trigger felony reckless burning charges.
