NY Penal Law 270.00 criminalizes possession and sale of fireworks statewide. While a 2015 amendment legalized sparklers and ground-based sparkling devices in most of NY, NYC (all five boroughs including the Bronx) expressly opted out. NYC Admin Code 10-104 reinforces a total ban. FDNY and NYPD run annual crackdowns before July 4th, with tip line 1-833-NYC-8477. Only licensed professional pyrotechnicians with FDNY permits may use fireworks at public displays.
Possession: class B misdemeanor, up to 90 days jail and $500 fine. Sale: class A misdemeanor, up to 1 year jail and $1,000 fine. Aggravated possession (over 50 lbs): class E felony.
