NYC DOB treats above-ground pools as accessory structures. Pools with water depth over 24 inches are regulated identically to in-ground pools under BC 3109: alteration permit, zoning analysis, electrical filings, and barrier compliance. Pools with 48+ inch smooth outer walls may use those walls as the required barrier if access is controlled by a removable/lockable ladder or a lockable safety ladder per BC Appendix G. Soft-sided inflatable pools are not exempt if depth exceeds 24 inches.
