Pushcarts and pedestrian mobile carts in Cleveland must be licensed under Codified Ordinances Part 6 and, if selling food, licensed by Cleveland Public Health as mobile food service operations. Carts must meet construction, sanitation, and identification standards, cannot obstruct sidewalks, and must be stored at a licensed commissary when not operating.
Pushcarts — including hot-dog carts, pretzel carts, shaved-ice carts, and coffee carts — are regulated in Cleveland under CCO Part 6 peddler/mobile-vendor rules and, for food, under Ohio Revised Code Chapter 3717 and Cleveland Public Health's mobile food service operation licensing. Cart operators must submit plans showing NSF-listed or equivalent construction, potable water tanks, wastewater holding tanks sized at least 15% larger than potable tanks, handwash sink with warm water, covered food storage, mechanical refrigeration where required, and approved overhead covering. Carts must display the operator's license and business name and cannot be used for preparation beyond limited hot-holding, assembly, and reheating unless additional equipment is approved. Commissary storage and cleaning at a licensed kitchen between shifts is required under Ohio food code; overnight street storage is not permitted. On the sidewalk, carts must leave a pedestrian clearance (typically a minimum of 5 to 6 feet) and cannot block building entrances, fire hydrants, crosswalks, or ADA-required paths. Carts cannot be left unattended in the right-of-way. Propane tanks are limited in size and must be secured; the Cleveland Fire Prevention Bureau may inspect. Health inspectors can perform unannounced inspections and have authority to suspend operations for critical violations such as no handwash, no refrigeration, or contamination.
