Under SB 946 (Cal. Gov Code 51038), San Leandro cannot ban sidewalk vending citywide but may restrict it in specific zones based on objective health, safety, and welfare concerns. Vending is generally permitted on commercial sidewalks but restricted in parks, near schools, and at permitted special events.
California Government Code 51038 limits local restrictions on sidewalk vending to objective concerns. San Leandro generally allows sidewalk food and merchandise vending on commercial corridors (East 14th Street, MacArthur Boulevard, Davis Street, Marina Boulevard commercial frontages) provided the vendor maintains 48 inches of ADA clear pedestrian width. Vending is restricted within 500 feet of a permitted farmers market, parade route, or special event without express consent of the event organizer. Park vending requires a separate Parks & Recreation permit and is generally prohibited in passive-use parks. Vending within 25 feet of a marked crosswalk, fire hydrant, or driveway is prohibited. Stationary carts must not occupy more than 4 feet of sidewalk and must remove all equipment nightly.
Restricted-zone violations carry administrative fines capped by SB 946 ($250 first, $500 second, $1,000 third within 12 months). Vending in city parks without a Parks permit is a separate misdemeanor under SLMC Title 5.
