Under NC Residential Code Appendix NC-A, an above-ground pool is treated the same as an in-ground pool for barrier purposes, enforced by Buncombe County Permits & Inspections. The pool structure itself may serve as the barrier, or a barrier may be mounted on top, provided the top is at least 48 inches above grade. Where access is by a ladder or steps, they must be capable of being secured, locked, or removed, or be surrounded by a compliant barrier, and any opening created when the ladder is removed must not pass a 4-inch sphere. A building and electrical permit from Permits & Inspections is still required.
An above-ground pool without a compliant, secured means of access fails inspection. Buncombe County Permits & Inspections can issue correction and stop-work orders and withhold the certificate of completion until barrier and ladder-security requirements are met.
