Delaware County has no above-ground pool ordinance. Any pool, spa, or hot tub accessory to a one- or two-family dwelling must comply with the International Swimming Pool and Spa Code of 2021 under 34 Pa. Code § 403.26. The ISPSC treats a structure holding more than 24 inches of water as a pool subject to barrier requirements; an above-ground pool wall of at least 48 inches can serve as part of the barrier if ladders are removable or lockable. Your borough or township issues the permit and inspects.
