Above-ground pools over 24 inches deep in Mecklenburg County require a building permit and the same 48-inch barrier as in-ground pools. Pool walls of 48 inches or greater may serve as the barrier if access ladder is removable or lockable.
Per NC Residential Code AG105.2, where the pool wall itself is at least 48 inches tall, the ladder or steps must be removable, secured, or enclosed by a compliant barrier. Setbacks match in-ground pools. Soft-sided temporary pools under 24 inches and under 5,000 gallons are exempt from permitting but must still be drained when unattended. Electrical for pumps requires a GFCI permit.
