Above-ground pools get lighter treatment under Fishers' Unified Development Ordinance than permanent in-ground pools. Sec. 6.2.2.D (Building Permit Exemption) states that a building permit is not required for several backyard features 'as determined by the Director,' and the list expressly includes 'above ground pools' alongside outdoor fireplaces, children's playhouses, swings, other play structures, basketball goals, and pergolas. Even though no building permit is required for the pool structure itself, the UDO's pool placement standards in Sec. 6.2.2.E still apply: the water perimeter of an in-ground or above-ground pool must be no closer than five (5) feet from any rear or side property line, and any hardscape around the pool edge must be at least one (1) foot from the side or rear property line and is counted as impervious surface. Importantly, the building-permit exemption does not waive safety requirements. If the above-ground pool is capable of a water depth greater than 42 inches, the Indiana Residential Code Section R326 barrier and gate requirements apply (a barrier at least 4 feet high with self-closing, self-latching, lockable access), which the local building official enforces. Electrical work for a pump or filter may also require an electrical permit. Homeowners should confirm placement against easements and HOA architectural rules, which can be stricter than the city standards.
Although the structure may be permit-exempt, an above-ground pool placed inside the 5-foot setback, within an easement, or without the required Section R326 safety barrier (when over 42 inches deep) can draw a correction order from Planning & Zoning or the building official.
