Above-ground pools are regulated identically to in-ground pools under NY Residential Code when water depth exceeds 24 inches. The pool wall can serve as the required 48-inch barrier if the top of the pool is at least 48 inches above grade and access (ladder or stairs) is removable and secured when the pool is not in use, or enclosed by its own 48-inch barrier per AG105.2(9).
