Above-ground swimming pools are permitted as accessory uses at single-family residences in Lincoln. Prefabricated above-ground pools with a water depth under 24 inches are generally exempt from the building permit requirement. Pools exceeding 24 inches in depth require a building permit from the Lincoln Building and Safety Department. Under LMC 8.36.020, above-ground pools with rigid walls exceeding four feet in height are considered to have a built-in barrier and do not require an additional surrounding fence. However, all ladders, steps, and other access points must be removed or locked in the raised position when the pool is not actively in use. Inflatable pools and temporary wading pools holding less than 18 inches of water are not subject to the barrier requirements. Electrical connections for pool pumps and filters require a separate electrical permit and must include GFCI protection per the adopted electrical code. Pools must be set back from property lines in accordance with accessory structure setback requirements.
