Under Nebraska law (NRS 81-15,264), the definition of swimming pool includes spas, hot tubs, and whirlpools designed for recreational use that are not drained after each use. Lincoln Municipal Code Chapter 8.36 applies the same barrier and safety requirements to hot tubs as to swimming pools. A hot tub or spa holding 18 or more inches of water must have a barrier or approved safety cover. A lockable, ASTM F1346-compliant safety cover that can support the weight of a child is generally accepted as meeting the barrier requirement in lieu of a fence. Installation of a permanent hot tub typically requires a building permit and a separate electrical permit for the dedicated circuit, GFCI protection, and proper bonding. Hot tubs must also comply with the VGB Act for anti-entrapment drain covers. Portable plug-in hot tubs under 24 inches of water depth may be exempt from the building permit requirement, but the electrical connection must still meet code.
