Lincoln Municipal Code Chapter 8.36 (Family Swimming Pools) Section 8.36.020 mandates enclosures, barriers, and safety covers for residential pools. Any pool holding 18 inches or more of water must be surrounded by a barrier at least four feet tall. If the pool is located within an enclosed residential backyard that already has fencing meeting the height requirement, no additional separate pool fence is needed. Above-ground pools with walls exceeding four feet in height satisfy the barrier requirement without a separate fence, but all ladders and access points must be removed or secured when the pool is not in use. Gates in pool barriers should be self-closing and self-latching with the latch on the pool side out of reach of small children. The Nebraska Residential Code Chapter 42 also applies, incorporating ASTM barrier standards. Violations are subject to penalties under LMC 8.36.050.
