Above-ground pools capable of holding water more than 24 inches deep are subject to New York State barrier requirements, the same as in-ground pools. If an above-ground pool is 48 inches or taller and has no attached deck, the access ladder must be lockable or removable to prevent unauthorized pool entry when not in use. If a deck is added to an above-ground pool, a building permit is required from the local municipality, and the standard 48-inch fence barrier requirements then apply to the deck perimeter. Above-ground pools over 24 inches deep still require a building permit in most Monroe County municipalities. Pool alarms are required (ASTM F2208 compliant). The pool and any associated electrical equipment must comply with NYS Residential Code electrical safety requirements.
