All swimming pools capable of holding more than 24 inches of water in Monroe County must be surrounded by a barrier at least 48 inches high under New York State Residential Code. Self-closing, self-latching gates are required.
New York State Residential Code (Appendix G / Section R326) and Monroe County municipalities require that all pools capable of holding water more than 24 inches deep be enclosed by a barrier. The barrier (fence) must be at least 48 inches high measured on the outside of the enclosure. Openings in the barrier cannot allow passage of a 4-inch diameter sphere. Chain-link fences must have a maximum 2ΒΌ-inch mesh unless fitted with slats reducing openings to 1ΒΎ inches. Gates must be self-closing, self-latching, open outward away from the pool, and have latches on the pool side at least 40 inches above grade. All gates must be lockable with a childproof lock. The fence should not provide footholds for climbing on the outside. If the house wall serves as part of the barrier, doors opening into the pool area must have alarms and windows must have devices limiting opening to less than 4 inches. Monroe County Department of Environmental Health oversees public/semi-public pool regulations under NYS Sanitary Code Subparts 6-1, 6-2, and 6-3.
Non-compliant pool barriers can result in permit denial, stop-work orders, and required corrections before pool use is permitted.
