Rochester requires all residential swimming pools to be enclosed by a barrier at least 48 inches high under the New York State Residential Code. Gates must be self-closing and self-latching. The requirement applies to all pools including in-ground, above-ground, and hot tubs.
The NYS Residential Code requires a continuous barrier of at least 48 inches around all swimming pools. Gates must be self-closing and self-latching with the latch on the pool side at least 54 inches above grade. Openings must not allow passage of a 4-inch sphere. The home wall may serve as part of the barrier if doors have alarms or the pool has an approved safety cover. Building permits include barrier inspection.
Pool barrier violations are treated seriously due to child safety. Violations carry immediate fines of $250β$1,000 and mandatory correction within 48 hours. Repeated non-compliance may result in pool condemnation orders.
