Tennessee law treats aboveground pools like in-ground pools. Any structure holding water over 36 inches deep, including aboveground and on-ground pools, is a swimming pool subject to the state pool-alarm law and county permitting.
Under T.C.A. § 68-14-802 a 'swimming pool' includes in-ground, aboveground, and on-ground pools plus hot tubs and nonportable spas that contain water over 36 inches deep, so aboveground pools carry the same Katie Beth's Law alarm duty. Separately, Rutherford County requires a building permit for any aboveground pool holding more than 24 inches of water, and the four-foot barrier rule still applies. A tall aboveground pool wall may serve as the barrier only where deck and ladder access are secured to IRC Appendix G.
Installing an aboveground pool without a permit, barrier, or alarm can halt work and draw code-enforcement action until it meets county and state requirements.
