Larger or non-prefabricated above-ground pools require a building permit through Permit Sonoma. Under CNI-044 and Health and Safety Code section 115921, a private swimming pool includes any in-ground or above-ground structure containing water over 18 inches deep, so drowning-prevention safety features and enclosure rules apply regardless of permit exemption. Electrical or plumbing work may still need separate permits.
Installing a pool that requires a building permit without one is subject to Sonoma County code enforcement action, and unpermitted work may require retroactive permits and corrections before use.
