NYS Residential Code Appendix G (adopted in 19 NYCRR Part 1225, effective May 2020) treats above-ground pools over 24 inches in depth as requiring the same 48-inch barrier protection as in-ground pools. However, it allows the pool wall itself to serve as the barrier if the wall is at least 48 inches high on all sides AND any ladder or steps are removable, lockable, or fold-up/retractable when the pool is not in use. Deck-mounted pools with attached platforms require a complete 48-inch barrier around the deck. All installations need a building permit from the town, village, or city building department - fees typically $100-$300. Electrical bonding under NEC Article 680 is mandatory and must be inspected. NY Executive Law 387(14) pool alarm (ASTM F2208) requirement applies to above-ground pools built or substantially modified after December 14, 2006. Setbacks follow town zoning - typically 10-15 feet from side/rear lot lines, further from front. Flood-zone restrictions apply along Hudson River properties in Poughkeepsie and Beacon AE zones. Winter covers compliant with ASTM F1346 are recommended but not code-substitutes.
