When a building permit is issued, the drowning-prevention safety-feature requirements of California's Swimming Pool Safety Act (Health & Safety Code 115922-115923) apply equally to above-ground pools, so the pool wall, ladder, or surrounding barrier must satisfy the 60-inch barrier and self-latching standards or another approved combination of features.
Placing an above-ground pool in a required setback or within five feet of a property line violates the zoning code, and installing a permit-triggering pool without a permit or required safety features is a building-code violation enforced by Building & Safety and Code Compliance.
