Above-ground pools are permitted in most Waukesha County zoning districts. No separate fence is needed if the pool walls are at least four feet above grade and extend at least five feet from the pool, but a lockable ladder is still required.
Section 3.19(1)(C) of the Waukesha County Basic Zoning Ordinance provides that where the pool is an above-ground pool, no additional fence or wall is required if the walls of the pool are at least four feet above the grade of the land completely surrounding it and extend at least five feet from the pool walls. Any access ladder must be lockable, tippable or otherwise placed to prohibit child access. Above-ground pools must still meet the setback and offset requirements of the applicable district and require a county zoning permit under Section 3.03. In cities and villages, the local ordinance controls.
An above-ground pool without a permit, conforming wall height or secured ladder violates Section 3.19 and the zoning permit conditions.
