NY Residential Code Appendix G sec. AG105.2 allows above-ground pool walls 48+ inches to serve as the barrier provided access ladder is removable, secured, or surrounded by a 48-inch barrier when pool is in use. Suffolk County towns require building permits for any pool over 24 inches deep including soft-sided/inflatable pools if they meet that threshold. Electrical permit required for pumps, filters, heaters - must have GFCI protection and equipotential bonding per NEC 680. Drain/backwash to dry well per SCDHS Article 6 - cannot discharge to street, storm drain, or septic. Setbacks typically 10-15 feet from property lines per town zoning. Pool must be decommissioned (removed or drained) before sale disclosure.
