The state Montjoy Pool Safety Act (Miss. Code Ann. Β§45-43-7 and Β§45-43-9) mirrors the 48-inch enclosure standard for owners associations. Building Department permits both Private Pool and Owner Above/In-Ground Pool applications.
Olive Branch adopted the 2018 ISPSC, 2018 IRC, and 2018 IBC by ordinance of the Mayor and Board of Aldermen, plus the 2017 National Electric Code for pool electrical work. Pool barriers follow IRC Appendix G / Section R326 and ISPSC Section 305: minimum barrier height 48 inches measured on the side facing away from the pool; openings cannot allow passage of a 4-inch sphere; bottom of barrier within 2 inches of grade on solid surfaces or 4 inches on grass; vertical members 1.75 inches maximum apart on barriers under 45 inches tall; gates must open outward away from the pool, be self-closing and self-latching with the release mechanism at least 54 inches above the bottom of the gate, and have no opening greater than 1/2 inch within 18 inches of the latch. Where a wall of the dwelling forms part of the barrier, doors leading to the pool require alarms or self-closing/self-latching mechanisms. The Building Department issues four pool applications: Private Pool Permit (with site plan), Owner Above Ground Pool Requirement, Owner In Ground Pool Requirements, and Public Swimming Pool Permit; owner applications must be signed by the property owner. Mississippi state framework: Miss. Code Ann. Β§45-43-7 (Montjoy Pool Safety Act) requires owners associations to enclose pool yards with a 48-inch fence with no 4-inch openings; Β§45-43-9 sets gate self-closing and self-latching standards; Miss. Code Ann. Β§17-2-1 et seq. created the Mississippi Building Codes Council; Β§21-19-25 authorizes municipal adoption of building codes by reference. Public/commercial pools are also regulated by the Mississippi State Department of Health (15 Miss. Admin. Code Pt. 18). Permits are issued by the Olive Branch Building Department at (662) 892-9333.
Filling a pool without a permit, or failing the IRC/ISPSC barrier inspection on height, opening size, gate hardware, or door alarms, results in denial of final approval, stop-work orders, mandatory corrective work, and code-enforcement citations. An unfenced pool may be abated as a public nuisance and a child-safety hazard.
