South Carolina enforces pool barrier and fencing rules through statewide adoption of the International Residential Code. All residential pools deeper than 24 inches must have compliant barriers, gates, and alarms uniformly across the state.
The South Carolina Building Codes Council adopts IRC Appendix V under SC Code 6-9-50, mandating that residential pools and spas deeper than 24 inches be enclosed by a barrier at least 48 inches high. Openings must not allow a 4-inch sphere to pass, gates must be self-closing and self-latching with the latch at least 54 inches above grade, and the latch must open away from the pool. Where a dwelling wall serves as part of the barrier, doors leading to the pool must have alarms or the pool itself must have a power safety cover. Public and semi-public pools follow DHEC Regulation 61-51 with stricter perimeter fencing rules. Local governments may impose stricter setbacks but cannot weaken state code.
Non-compliant barriers can trigger stop-work orders during construction, certificate of occupancy denial, and civil liability if injury occurs. Fines vary locally up to $500 per day.
