Under FS 515.25 a spa or hot tub is treated as a residential swimming pool. FS 515.29 provides that a hot tub or spa with a safety cover that complies with ASTM standards need not be surrounded by a separate barrier, making an approved locking cover the common compliance path. Lee County requires permits for the electrical hookup and installation, reviewed under the Florida Building Code by the Building & Permitting Services division. Placement must also meet Land Development Code accessory-structure setbacks. Portable, cord-and-plug spas still need a listed safety cover to meet the Act.
Installing a spa without required electrical/building permits or a compliant safety cover can lead to code-enforcement action and failure of the final inspection.
