Hot tubs and spas in New York must meet Uniform Code barrier, electrical, and cover requirements, with public spas additionally regulated under Public Health Law Article 13-D.
Under 19 NYCRR Part 1228, residential spas and hot tubs over 24 inches deep require permits and either a 48-inch barrier or a listed safety cover meeting ASTM F1346. Electrical bonding and GFCI protection are mandatory. Public spas in hotels, gyms, and HOAs require DOH permits, certified operators, and water quality testing under Subpart 6-1 of the State Sanitary Code, applied uniformly statewide.
Non-compliant hot tubs face permit denials, removal orders, fines, and operating permit revocation for public spas. Owners may face civil liability for drowning or entrapment incidents.
