In unincorporated Montgomery County, no building permit is required, but Texas Health & Safety Code Β§757 enclosure rules apply to any spa capable of holding water deeper than 24 inches unless the spa has a locking, rigid safety cover meeting ASTM F1346 performance standards β this is the standard exception used in Texas case law.
