Texas Health & Safety Code Β§757 requires residential pools to have a barrier at least 48 inches high on all sides. Self-closing, self-latching gates are required. Montgomery County enforces state pool barrier standards through its development permit process.
Texas Health & Safety Code Chapter 757 mandates pool enclosures for all residential swimming pools. Barriers must be at least 48 inches high and completely surround the pool with no gaps a young child could squeeze through. Gates must be self-closing and self-latching, with the latch at least 54 inches from the ground or on the pool side. Doors from the house that provide direct pool access must have an alarm. Montgomery County verifies compliance through inspections associated with the development permit. Violations are addressed by the Environmental Health department.
Non-compliant barriers: immediate correction. Fines $100 to $500. Significant liability for drowning incidents.
