Shenandoah, TX Swimming Pools & Spas: Fencing & Safety Requirements (2026)

Section 14-32(a) of Chapter 14, Buildings and Building Regulations, adopts a list of International Code Council model codes as the regulations governing construction activity in the city, and item (6) on that list is the International Swimming Pool and Spa Code, 2021 Edition. The same subsection makes it unlawful to erect, modify or construct any building or structure, or change its use, in violation of or without complying with the adopted codes, and reserves the city's right to require additional permits or impose stricter written policy beyond what the adopted code text requires.

Because Shenandoah adopted the ISPSC by reference rather than rewriting its own separate pool-fence ordinance, private and public pool construction, including the barrier, gate, and enclosure specifications built into that model code, falls under this adopted framework rather than a locally drafted fence-height ordinance. Section 14-2 extends Chapter 14's coverage, and so this adopted pool code, to new construction within the city's extraterritorial jurisdiction as well as inside the corporate limits. Permit fees for pool-related construction fall under the general fee schedule described in Section 14-36, which covers development, mechanical, and other inspection fees and is kept on file in the office of the city secretary. This is a distinct, city-adopted regulation and is not the same as the state's HOA-focused pool enclosure statute.
