A private residential hot tub or spa with a lockable safety cover meeting ASTM F1346 is generally exempt from the pool barrier under the state-adopted IRC. Public or shared spa pools are regulated as water recreation facilities under WAC 246-260.
Washington's adopted IRC Appendix G exempts a residential spa or hot tub from the surrounding-barrier requirement when it is equipped with a safety cover complying with ASTM F1346; without such a cover the 48-inch barrier applies. A spa still needs the appropriate electrical and, where applicable, building permit from Spokane County. A spa serving the public or more than one household is a "spa pool" and "water recreation facility" under WAC 246-260-010, subject to the full construction/operating-permit and barrier rules for public pools.
A residential spa without a compliant cover or barrier fails inspection; a public spa pool operating without a WRF permit can be closed by the health officer.
