The key exception: hot tubs or spas that meet the self-contained definition and have a locking safety cover complying with ASTM F1346-91 are exempt from the fence enclosure requirement, and a self-contained unit may be recessed below an adjoining floor, deck or grade if allowed by the manufacturer's specifications and the cover operates normally. Spas that are not self-contained, or that lack a complying locking cover, must meet the full enclosure rules (60-inch permanent barrier, 2-inch bottom clearance, no 4-inch sphere passage, self-latching gate) plus one drowning-prevention safety feature, the same as a pool. A building/electrical permit through CDRA Building Services is generally required for spa installation and bonding.
A non-exempt spa must satisfy the enclosure and safety-feature requirements before it is filled. Failing to provide a complying locking cover (for the self-contained exemption) or an enclosure can trigger code enforcement and prevent permit issuance.
