Under Montana's adopted ISPSC, a residential spa or hot tub is exempt from the pool barrier requirement if it is equipped with a lockable safety cover meeting ASTM F1346. Public spas are licensed and inspected by RiverStone Health.
Residential hot tubs and spas fall under the same ISPSC Section 305 barrier rules as pools, but Section 305.1 provides an exception: a spa or hot tub equipped with a lockable safety cover complying with ASTM F1346 need not comply with the surrounding-barrier requirements. Without such a cover, a 48-inch barrier is required where a building code applies. Public and semi-public spas (at hotels, gyms, or apartments) are licensed and inspected annually by RiverStone Health Environmental Health Services, with disinfectant and safety checks. On rural unincorporated land with no adopted code, the county may set no local rule, but a compliant safety cover remains the recommended standard.
Public spa operators failing inspection face correction or closure. Residential spas without a compliant cover or barrier can be cited where a code applies.
