The Douglas County Building Division permits hot tubs and spas under the adopted 2021 IRC and International Swimming Pool and Spa Code; the electrical permit covers required bonding and GFCI protection. Under Section 305, a spa or hot tub is exempt from the surrounding-barrier requirement when it has a listed, lockable safety cover complying with ASTM F1346. Without such a cover, the spa must be enclosed by a compliant barrier with self-closing, self-latching gates. Public or commercial spas (HOA, apartment, gym, or short-term-rental spas serving guests) are additionally regulated as spas under state rule 5 CCR 1003-5.
Installing a spa without permits, or leaving it uncovered and unfenced, is a building-code violation; unsafe public spas can be closed under 5 CCR 1003-5.
