State law, not the county, sets pool safety standards. Chapter 757 requires self-closing, self-latching gates that open away from the pool, and public pools follow DSHS rules on drains, signage, and equipment. Cities enforce these inside their limits.
Brazoria County has no zoning power to write pool safety codes, so safety rules come from Texas Health & Safety Code Ch. 757 (enclosures, gates, door and window safeguards) and, for public pools, the DSHS Standards for Public Pools and Spas (25 TAC Ch. 265) covering drain covers, depth markings, and lifesaving equipment. Gates must be self-closing and self-latching and open outward away from the pool yard. Enclosures, gates, and latches at multiunit pools must be inspected at least every 31 days. Inside cities, municipal building and health officials enforce barrier and alarm requirements at inspection.
Failure to maintain required safety features is an offense for public-pool operators enforced by the health authority; private-pool safety inside cities is enforced through city building-code penalties.
