Public and semi-public pools in Colorado must submit construction plans to the state health department at least 30 days before building, be inspected, and be certified as built-as-approved before use. Barriers, disinfection, and drain standards under 5 CCR 1003-5 apply. Private residential pools are exempt.
Under 5 CCR 1003-5, Article II: "At least thirty (30) days prior to the construction, extension, enlarging, remodeling or modification of a public swimming area or related facilities, the plans and specifications... shall be submitted for review and recommendations to the Colorado Department of Health." The pool "shall not be placed in use until all facilities necessary for compliance... are installed and operable and approved." Wading areas must be separated from the main pool by a safety barrier or buoy line. These rules apply to hotel, HOA, club, and community pools; a "private pool" used solely by residents of a single-family dwelling, condo, or apartment (def. 11) is "exempt from these regulations."
CDPHE may issue a summary closure order when a pool poses an imminent threat to public health, requiring it to stay closed until conditions are brought into compliance.
