When unincorporated Kern County issues a permit to build or remodel a pool or spa at a private single-family home, state law requires at least two of seven drowning prevention safety features, verified by the building official before final approval.
Health and Safety Code Section 115922 lists the seven qualifying features: a compliant enclosure isolating the pool from the home, removable mesh fencing meeting ASTM F2286 with a self-closing, self-latching lockable gate, a safety cover meeting ASTM F1346-23, exit alarms on doors and windows with direct pool access, a self-closing, self-latching door device with its release mechanism at least 54 inches above the floor, an ASTM F2208 water entry alarm, or other independently verified equivalent protection. Certain pairings, such as an exit alarm plus a self-latching device on the same door, do not count. Kern County applies these rules in unincorporated areas through its adopted California Residential Code (Kern County Ordinance Code Chapter 17.06).
Section 115922(c) directs the local building code official to inspect the drowning prevention safety features and to give final approval of the permitted construction or remodeling only if no violations are found.
