Residential pool safety in Nashua is governed by the 2021 ISPSC adopted under NRO Sec. 105-25. Key safety provisions: 48-inch barrier (Sec. 305.2.1), 4-inch sphere rule (Sec. 305.3), self-closing/self-latching gates that open outward (Sec. 305.5), dwelling-wall doors leading to the pool must have an alarm meeting UL 2017 or be self-closing/self-latching (Sec. 305.6), and an approved safety pool cover meeting ASTM F1346 may serve as an alternative for hot tubs and spas. Public pools also follow RSA 485-A:26 and NH DES Env-Wq 1100 per NRO Sec. 105-26.B, including federal Virginia Graeme Baker Pool and Spa Safety Act drain-cover requirements.
NRO Sec. 105-25 adopts the ISPSC, including Section 305 (Barriers for Outdoor Swimming Pools and Spas) and Section 306 (Indoor Swimming Pools). ISPSC Sec. 305.6 addresses dwelling walls used as part of the barrier: where a wall of a dwelling serves as part of the barrier, doors with direct access to the pool must be equipped with an alarm conforming to UL 2017, or the pool must be equipped with a safety cover meeting ASTM F1346, or all doors with direct access must be self-closing and self-latching with the release mechanism a minimum of 54 inches above the floor. NRO Sec. 105-26.B amends ISPSC Sec. 101.1 to add: '101.1.1 Public Swimming Pools and Spas shall also be regulated by NH DES Public Pool and Spa Program in accordance with RSA 485-A:26 and Env-Wq 1100 Public Bathing Place.' Env-Wq 1100 incorporates federal Virginia Graeme Baker Pool and Spa Safety Act drain-cover standards. The City of Nashua's published pool rules for public pools (Centennial, Crown Hill, Rotary, and Greeley Park wading pool) provide that 'CHILDREN EIGHT (8) YEARS OLD AND YOUNGER MUST BE ACCOMPANIED BY PARENT/GUARDIAN AT LEAST 18 YEARS OF AGE,' with no diving except in designated red-lined areas at Crown Hill and Rotary. Appeals follow NRO Sec. 105-5 per NRO Sec. 105-26.F.
A dwelling-wall door with direct access to an unfenced pool that lacks an alarm meeting UL 2017, self-closing/self-latching hardware, or an ASTM F1346 safety cover violates ISPSC Sec. 305.6 (as adopted by NRO Sec. 105-25). Public pools operating without compliance with NH DES Env-Wq 1100 and RSA 485-A:26 (including VGBA drain-cover requirements) violate NRO Sec. 105-26.B. Disabled or removed barrier hardware on a previously approved residential pool is a continuing violation under NRO Sec. 105-6.
