For public and municipal pools, OAC Chapter 3701-31 governs perimeter barriers, water chemistry, safety equipment and staffing. A licensed public pool must report to the licensor within 72 hours any incident within the pool perimeter that results in death, serious injury, EMS assistance, or an illness involving more than one person. Public Health inspects bi-weekly. Private residential pools are not licensed but must meet Residential Code of Ohio barrier requirements (48-inch fence, self-latching gates, 4-inch-sphere openings) at building-permit inspection. There is no separate Montgomery County ordinance layered on top of these state rules.
Public-pool safety violations can lead to license suspension, revocation or closure. Failure to report a serious incident within 72 hours is itself a rule violation.
