Michigan has not enacted a flavored tobacco or menthol ban and continues to preempt local product bans through its tobacco licensing scheme. Detroit cannot prohibit flavored vape or menthol cigarette sales by local ordinance.
Unlike Massachusetts, California, or some Minneapolis-area cities, Michigan has no statewide flavored tobacco ban as of 2026. A 2019 emergency rule by the state health department to ban flavored vapor products was struck down in Marquette County Circuit Court, and subsequent legislative attempts have stalled. Michigan's tobacco product taxation under MCL Β§205.421 et seq. and the Youth Tobacco Act preempt municipalities from banning particular products, leaving Detroit unable to bar menthol cigarettes, flavored cigars, or flavored vape liquids. The Detroit Health Department continues anti-tobacco education, especially in schools, but local ordinance authority is limited to public smoking restrictions under the Smoke-Free Air Act MCL Β§333.12601 et seq. and Detroit Code Chapter 17.
Because flavor regulation is preempted, retailers face no Detroit penalty for selling flavored products. Any future local ordinance attempting a flavor ban would likely be invalidated under Michigan's tobacco preemption framework.
