Washington state has not passed a comprehensive ban on flavored tobacco or vapor products. The Washington State Board of Health enacted an emergency rule in 2019 banning flavored vapor products, but the rule expired. Currently, federal FDA premarket tobacco product authorization rules restrict most flavored cartridge-based e-cigarettes other than tobacco and menthol. Disposable vapor products and open-system e-liquids in various flavors remain widely available. Some Washington cities have considered local flavor restrictions, but RCW 70.345 and tobacco laws may limit local authority. Legislation to ban flavored tobacco statewide has been introduced repeatedly but not enacted. Sales to minors of any flavored product remain prohibited under RCW 26.28.080.
Federal FDA violations for unauthorized flavored cartridges may result in seizures and fines. State enforcement focuses on age restrictions and licensing rather than flavor bans.
