Ordinance 2021-46 enacted Chapter 45 (Tree Protection Regulations) of the ULDC. Tree removal authorization is required for anyone removing, relocating, or causing irreparable injury to a regulated tree, with key exceptions for owner-occupied homes after 1 year of CO, exotic invasive species, and danger trees.
Ch. 45 is one of the more substantive Florida municipal tree ordinances. Sec. 45-3 sets the basic permit requirement and Sec. 45-8 provides the tree credit/debit calculation used for replacement. Owner-occupied 5-acre-or-smaller lots get the most common exception after the 1-year CO window. Florida HB 1159 (2019) preempted local tree-removal authority for documented dangerous trees on residential property when a certified arborist confirms the danger in writing, so the City must accept an arborist letter for danger-tree removal without permit. Carlton Reserve and other protected lands have separate state/federal protections.
Unauthorized removal can trigger Sec. 45-8 replacement requirements (often 3:1 or higher), Code Enforcement fines up to $500/day, and a stop-work or 'no further development permits' status until cured.
