North Port's noise rules are codified in Code of the City Chapter 46, Article II, Division 2 (Sec. 46-41 et seq.). The City Commission has long held that 'excessive and unnecessary noise endangers the physical and emotional health and welfare of the people' (Ord. 79-54), and continuously created noise that disturbs the peace of any neighborhood is prohibited.
Chapter 46 Article II Division 2 regulates unreasonable sound from pumps, air conditioning, air-handling equipment, amplified sound, and mechanical equipment, with exemptions previously codified at Sec. 46-42(13) and exception procedures at Sec. 46-45. The City's general penalty clause applies (up to $500 per offense, $1,000 for repeat code violations under F.S. §162.09), and the special master in code enforcement hearings may impose escalating daily fines until compliance is achieved.
