Ordinance 2016-42 amended Sec. 53-121(H) of the ULDC to permit hens as accessory to a single-family residence in Residential Single-Family (RSF) districts: up to 4 hens on an 80'x120' lot or 6 hens on two or more lots, NO ROOSTERS, no slaughter, and a fixed set of coop and setback rules.
Sec. 53-121(H) sets out detailed hen-keeping standards: (1) 4 hens on 80'x120', 6 hens on two or more lots; (2) no slaughter on premises; (3) hens must be in covered/fenced enclosure at all times and secured in coop during non-daylight hours; (4) at least 4 sq ft per hen in the coop; (5) coop in side/rear yard only, at least 10 ft from any adjacent property line and 25 ft from adjacent residential structures, no detectable odor at property boundaries; (6) rodent/predator-proof construction; (7) secure feed storage; (8) no commercial egg sales in RSF districts; (9) dogs/cats killing hens are not 'dangerous'; (10) hens only - no other fowl. Sec. 53-122(C) keeps farm animals, exotic animals, livestock, and poultry (other than hens under §53-121(H)) prohibited in residential districts. Unwanted chickens go to the Health & Human Services Mosquito Control Division's Sentinel Chicken Program, not Animal Control (§53-121(H)(11)).
Violations of Sec. 53-121(H) or Sec. 53-122(C) are Code Enforcement matters with fines up to $500/day before the special master. Repeat violations or unsanitary conditions can trigger Sarasota County Animal Services and Health Department involvement.
