Unincorporated Polk County requires no tree-removal permit for private residential lots; Florida Statute 163.045 bars local permits/fees when a certified arborist finds the tree dangerous. The Land Development Code preserves trees only through development-plan review and replacement credits.
Polk County has no stand-alone county-wide tree-preservation permit for existing single-family lots in unincorporated areas. Instead, tree protection operates through the Land Development Code at the development-approval stage: Section 720/721 lets developers earn credit for preserving existing canopy trees (a 36-inch-DBH tree equals seven required trees), and preserved trees that later die must be replaced. Florida Statute 163.045 preempts local permit, fee or mitigation requirements for pruning or removing a residential-property tree documented as dangerous by an ISA-certified arborist or Florida-licensed landscape architect. Wetland/conservation-easement trees stay under SWFWMD/DEP jurisdiction, and cities set their own tree-removal permits.
No county permit or penalty for lawful residential removal. Removing preserved/credited development trees without replacement, or wetland trees without environmental permits, can bring code or SWFWMD/DEP enforcement and mandatory replanting.
