Florida law (FS 791.08) lets residents use consumer fireworks solely on New Year's Day, July 4th, and New Year's Eve. Outside those dates, only sparklers/novelties are generally lawful. Countywide burn bans override this and prohibit fireworks during drought.
Florida's 2020 fireworks law, FS 791.08, permits the use of fireworks 'solely and exclusively during a designated holiday' โ New Year's Day (Jan 1), Independence Day (Jul 4), and New Year's Eve (Dec 31). On all other days, only sparklers and approved novelties from a registered seller are lawful (FS 791.02). Homeowners' associations may not abrogate a homeowner's holiday right (FS 791.08(3)). When Polk County declares a burn ban, personal-use fireworks are prohibited countywide regardless of the holiday. Public displays require a permit from the Board of County Commissioners in unincorporated areas.
Illegal sale/use outside holidays is a misdemeanor under FS Ch. 791. Using fireworks during a Polk burn ban violates Ordinance 08-015: fine up to $500 or up to 60 days jail.
