A parish tree-removal permit applies only to trees on the public right-of-way. Parkways reserves the right to deny removal of a mature, healthy right-of-way tree. No permit is needed to remove a tree entirely on your own private property.
Jefferson Parish protects trees on parish-owned right-of-way and public property through the Parkways Department under Code Chapter 37, Article II. To work on a right-of-way tree an inspector investigates and issues a permit letting an owner hire a qualified company at their own expense. The department reserves the right to deny removal of a mature, healthy tree, and removes healthy public trees only when they obstruct traffic, block the view of traffic, or endanger the public or water or sewer lines. Trees fully on private land need no parish permit. Encroaching neighbor branches or roots are handled separately under Louisiana Civil Code article 688 (see the exact text below).
Removing a protected right-of-way or public tree without a Parkways permit is enforced by the department, which may deny removal and require replacement.
