Commercial orchard operations (walnut, almond, cherry, stone fruit) and other bona fide agricultural activities on AG-zoned land are exempt under California Civil Code Β§3482.5 (Right to Farm) and the ordinance's agricultural-operation exception. Street trees in county-maintained right-of-way (parts of Mountain House, Spanos Park, other CSAs) are maintained by Public Works and cannot be pruned or removed by adjacent residents. CEQA may require a mitigated negative declaration for removals exceeding 5 protected oaks or 1 acre of oak woodland.
Unauthorized removal of protected oak: civil penalty $500β$10,000 per tree (scales with size), plus 3:1 replacement or in-lieu fee. Removal during nesting season (FebβAug) may additionally violate Migratory Bird Treaty Act. Felony referral for large-scale unpermitted clearing.
